This is a translation of the German terms and conditions. Since Stainless is a German company the relevant terms and conditions are the German. The language of the contract is German.
- Scope of Application
This Terms and conditions settles the business relation between York Keller, owner of Stainless and the web shop www.stainlesswear.com in the succession called the seller and its customers.
We handle orders according to the terms and conditions valid at the time of the order.
The valid terms and conditions are provided on our web site: www.stainlesswear.com as a direct link at the bottom of each page. Furthermore we send you the terms and conditions with every confirmation of an order.
German is the language of negotiations, and the contract. The following terms and conditions are the exclusively valid also for all foreign business.
- Conclusion of the contract
The offer in the Internet are not a legally binding offer.
You can order written by mail, or via our web shop. After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail order confirmation. The contract between us will only be formed when we send you the order confirmation, or a bill. If we do not accept your offer within 7 days the contract will not be formed. There is no contract formed about products that are not listed in the mail confirming the order.
- Conditions of Payment
All prices are in Euro and including VAT.
Shipping cost add according to the list under point 4. The prices at the moment of ordering apply. You have the following payment options:
Pay in advance, purchase on account, Ideal, Sofort Überweisung and Giropay.
The payment is due immediately with concluding the contract. If you pay in advance we send you an e mail with our bank details and an order number. Please pay only after you have received this mail.
We ship your order after we have received your complete payment including VAT and shipping costs. We will inform you immediately if we cannot deliver and refund your payments.
- Shipping costs
The shipping costs within Germany are EUR 5,00. Delivery time is ca. 3 – 5 days.
Returns within Germany is free of charge! Delivery and possible reshipment is carbon neutral through DHL Go Green!
We ship in the EU for EUR 11,00 per delivery.
- Right of Withdrawal

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Stainless York Keller, Eduard Rosenthal Straße 70c, 99425 Weimar Tel.: +49 170 8809883, Email: mail@stainlesswear.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery
(with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us),
without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise;
In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us.
The deadline is met if you send back the goods before the period of 14 days has expired. We will bear the cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
- Defects Liability
We guarantee defects liability according to the valid version of German law. You are obliged to prove the date of the purchase by sending us a copy of the receipt, and the product you complain about to:

The defects liability does not apply to normal wearing or fading.
- Care
Please follow the instructions on the hang tag. We are not liable for damage through wrong washing.
- Reservation of Property Rights, Compensation, Right of Retention
a) We reserve ownership rights to the property until the customer has paid the purchase price in full.
b) You are only entitled to set off own claims if its counter claims have been judicially established as final and absolute or have been acknowledged by us. Furthermore you are entitled to a right of retention only in so far as his counterclaim is based on the same contractual relationship.
c) If you default on any payment obligations, all outstanding claims are immediately due.
- Applicable Law
German law shall exclusively be applicable. To consumers these rights are only applicable insofar as no national law of the country of which the consumer is a resident of is violated.
Place of jurisdiction is Weimar respectively Jena, Germany.
- Final Clause
Should any particular contractual conditions be legally void the legally binding of all other conditions remains untouched. The void, ineffective or unenforceable provision shall be replaced by an appropriate provision which most closely approximates to the sense and purpose of this agreement and which the parties to the agreement would have wished if they would have taken into account the voidness, ineffectiveness, or enforceability.
